Personal data may be freely provided by the user, or collected automatically when using this application. Failure to provide certain personal data may make it impossible for this application to provide its services.

Methods of processing

Appropriate security measures will be taken by the data controller to prevent unauthorized access, disclosure, modification, or unauthorized destruction of personal data. Processing of the personal data will utilize computers and IT enabled tools according to the procedures for the purposes indicated. The data may be accessible to certain parties involved with the operation (administration, IT companies, communications agencies, hosting providers, technical services providers, etc) as appointed necessarily by the owner to process data. The data controller may collect, use, transfer, and disclose non-personal information for any purpose.

Retention time

The data is retained for the period necessary to provide services requested by the user, or stated by the purposes outlined in this document. The user can request that the data controller suspend or remove user data.

Please read this agreement carefully before using the software. Installation or use of the software shall constitute the express consent of the user to be bound by the terms of this agreement.

General

a. The Bilingual News application, and any third party software, documentation, interfaces, content, fonts and any data accompanying the software whether in read only memory, on any other media or in any other form are licensed, not sold, to the user by STEGA GK (BilingualNews) for use only under the terms of this agreement. BilingualNews reserves all rights not expressly granted to the user.

b. BilingualNews may make changes or updates to the software at any time without notice to user and has no obligation to maintain existing features or content.

Uses and Restrictions

a. User is granted a limited, non-transferable, non-exclusive license to install and use the application on any device that the user owns or controls. The user may not distribute or make the software available over a network where it could be used by multiple devices at the same time. The user may not rent, lease, lend, sell, redistribute or sublicense the application.

b. Title and intellectual property rights in and to any content displayed by or accessed through the software belong to the respective content owner. Such content may be protected by copyright or other intellectual laws and may be subject to terms of use of the third party providing such content. Except where otherwise indicated, this agreement does not grant any rights to use such content nor does it guarantee that such content will continue to be available to the user and the user may not use, extract or distribute, commercially or otherwise, on a standalone or other basis, any photographs, images, graphics, clipart, artwork or similar assets contained within, or provided as a part of, the software or services, or otherwise use the material outside the context of its intended use as part of the application.

c. The user may not copy except as expressly permitted, decompile, reverse engineer, disassemble, attempt to derive the source code of, decrypt, modify, or create derivative works of the application. and the The user agrees to download, install and use the application any any associated components in compliance with all applicable laws, including local laws of the country or region in which the user resides.

d. The rights under this agreement will terminate automatically or otherwise cease to be effective without notice if the user fails to comply with any of the terms of this agreement. Upon termination of this agreement, the user must cease all use of the application and destroy all copies, full or partial, of the application and its data.

Data Use

a. Privacy Policy. At all times the user’s information will be treated in accordance with the application’s privacy policy, which is incorporated by reference into this agreement.

b. The user understands that by using the application, the user may encounter content that may be deemed offensive, indecent, or objectionable, which content may or may not be identified as having explicit language. The user agrees to use the application at the user’s sole risk and that BilingualNews shall have no liability to the user for content that may be found to be offensive, indecent, or objectionable.

c. The user agrees that the application contains proprietary content, information and material owned by BiingualNews that is protected by applicable intellectual property laws, including but not limited to copyright. The user agrees that the user will not use such proprietary content, information or materials other than for permitted use of the application or in any manner that is inconsistent with the terms of this agreement.

Subscription Details

The subscription product offered in the application for ¥240 as an auto-renewing monthly subscription. The subscription will automatically renew unless turned off at least 24 hours before the end of the current period. Subscription fees will be charged to the user’s iTunes Account at confirmation of purchase and at subsequent renewals. Active subscriptions may be managed by the user in the user’s Account Settings. Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication, where applicable.

Liability

BilingualNews does not warrant against interruptions of service, errors or other problems that may arise with the application, nor that errors within the services provided will be corrected or that the services will continue to be available. No oral or written statement given by BilingualNews shall create a warranty or guarantee. To the extent permissible by law, in no event will BilingualNews be liable for personal injury or damages whatsoever arising out of or related to use of the application. The maximum remedy available to the user for any failure of the software product is a refund of actual fees paid, which refund shall be pro-rated to cover only the period of such failure.
